Housing For Felons – How To Get A Section 8 Voucher With A Felony
For many felons, finding affordable housing is a major struggle. One popular type of housing assistance for felons is the Section 8 choice voucher program.
Section 8 is a federally funded rental assistance program that exists in every state. It allows eligible individuals and families to rent an apartment from a participating landlord at a heavily discounted rated of about 60-70%
There are very strict eligibility guidelines, so many people with a criminal record get turned down. Still, while it is by no means easy to get Section 8, it can be one of the best long-term housing solutions for felons.
Here is what you need to know about eligibility, application process, wait time and how the program works.
Can felons get Section 8 housing?
According to Federal Regulations there are two felonies that automatically disqualify you from federally funded low income and subsidized housing programs. If you have one of these, you should NOT bother applying.
1. You have a lifetime registration on the sex offender registry
2. You have been convicted of the manufacture or production of methamphetamine (meth) in federally assisted housing.
Note, these two rules would apply to any member of your household on your application, and would disqualify you all as a family.
In addition to the federal regulations, each state has its own set of eligibility criteria that may disqualify some felons from applying.
Since the 1990’s many state and county Housing Authorities have adapted very strict eligibility guidelines in order to keep crime rates down within low income housing.
As a result, these new regulations may make it more difficult for some felons to qualify for the program.
HUD rules for felons
HUD uses the following guidelines to determine if someone with a felony convictions can be eligible for public housing:
– Your felony should be older than 5 years. Some places, like San Francisco Housing Authority have a 10 year requirement.
In some cases, your application may be accepted before the five year period if you have gone through a rehabilitation program and have a certificate of compliance.
You may be disqualified in the following situations:
You have been convicted of certain violent crimes, certain types of fraud, drug trafficking. (If you have such a conviction, you need to call your local Housing Authority and ask if you should apply).
You or a household member on the application has a documented history of drug and/or alcohol abuse.
There is a personal or family history of poor relationships with neighbors in your previous living arrangements. This can be fighting, bullying, verbal assaults, disturbance of peace, etc.
History of defaulting on your rent payments. Its important to note, that if you have always made at least 50% of your rent, but just were not financially able to pay in full, this situation will NOT be counted against you.
We strongly recommend that you either go to your local Housing Authority or call them, to find out what the eligibility criteria are in your area before you start filling out the paperwork.
How To Apply For Section 8 Housing
You should apply to as many local Housing Authorities as possible. You may find that some local Section 8 waiting lists have been closed and are no longer accepting applications.
You should always ask when the list will reopen again and check back to apply at that time.
When you apply as a felon, there will be a lot of paperwork involved and a number of different documents required from you.
First and most important, there will be a formal criminal background check. Thus, there is no point in trying to apply and lie on the application about your felony.
Here is a list of documents you will need to put together in order to apply (this list may be slightly different depending on the program. Always looks for specific guidelines on the HUD application).
-Standard Application (you can get it online on the website for your state’s Housing Authority, or at a local HUD office).
– Proof of citizenship/legal status
– Birth certificates
– Social Security number
– Pay stubs (at least 3 months, but many places require 6 or more months of proof of income)
– Bank statements
– Criminal background check
– Credit Score Check
– Tax forms
– Statement from government agencies about benefits, such as welfare payments or food stamps
– Proof of current residence
– list of all places you lived in the past 5 years.
Its very important NOT TO leave any gaps, even though it may be tempting to leave out a landlord that you may have had a bad relationship with. Any gaps you leave will still look bad and may potentially disqualify you.
Be sure to check the DEADLINE for the application and submit ON TIME!!! If you miss the deadline, the list will close. In many cases it does not reopen for at least 6-12 months.
Once you submit the application, you will need to go to a personal interview with a representative from the Housing Authority. This is your chance to state your case, and convince the official that you will be an exemplary tenant who will not cause any disturbance.
It is also a good idea to mention that you have a felony and to talk about the steps you have taken to be a productive citizen.
The Housing Authority may decide to call your previous landlords to get a sense of how you were as a tenant. It would be great if you could provide references of landlords who would say good things about you.
For your records, be sure to make copies of the application and of all the documents you have submitted. It is also helpful to start a log where you keep track of when and where you have applied, any follow up phone calls, etc.
Being organized will help you a great deal in this process, because often times agencies loose paperwork, and will require you to produce what they need fast.
Section 8 criminal background check
Anybody applying for section 8 housing must go through a mandatory criminal background check. This means that any felonies and misdemeanors you have had in the past will be uncovered. The PHA has the authority to terminate or deny your application based on the findings of the background check.
Even if you are not the primary applicant, but are part of the household that is applying for the voucher, you will still need to submit to a background check. PHAs make every effort to avoid giving Section 8 vouchers to individuals who may pose any type of threat or unrest to people living in public housing.
Furthermore, private landlords are legally allowed to run their own criminal background checks on prospective tenants who present a Section 8 voucher and want to rent an apartment or house.
Can you get Section 8 with no income?
Many ex-cons struggle with finding legal employment and often have no income to show for. The good news is that even if you have no job and no income, you can still be eligible for Section 8.
This is because HUD rules state that your income must be less than 50% of the median income in your area. Having 0 income qualifies under this rule.
Moreover, if you have a family member who has a felony conviction and no job, and he is applying with you for Section 8, your application will not be disqualified because of this person.
Who has priority?
If you will be found eligible, there are a number of situations that will push your application to the top. Your wait time can be reduced to as little as a couple of months.
You may get priority if:
1. You are currently living in a shelter or on the streets
2. Have a serious medical emergency
3. Your current apartment is condemned
4. You pay more than 50% of your income for rent
6. You are facing domestic violence
7. You are being evicted through no fault of your own
8. You are a local resident
Can a felon live with someone on Section 8?
There are many people who want to apply for section 8 housing, but a member of their household has a felony conviction. In this case, will their application be turned down?
The same rules would apply as for a felon who is the primary applicant for subsidized housing (see above). Registered sex offenders and methamphetamine drug traffickers are banned for life from applying to public housing. Most other types of convictions are reviewed by the local PHA on a case by case basis.
However, if someone already lives in Section 8 housing, and a convicted felon wants to join them in their living arrangement, the current tenant is obligated by law to report this updated situation to their local PHA. Based on the above criteria, the PHA will determine whether a felon can be allowed to live with the section 8 recipient.
Failure to report someone with a felony who started living with you in Section 8 housing can result in permanent termination of your benefits. In many cases, you may never be allowed to get public housing assistance again.
Having an unauthorized guest
If you have a friend or family member who is a convicted felon and wants to stay with you in your housing for a few days, there are strict guidelines you must follow.
First, you must ask permission from your landlord and local PHA and disclose that the guest has a felony. Depending on what the charges are, this person may not be allowed to stay with you. You must follow the rules, otherwise, you will be committing fraud.
Moreover, if a felon is allowed to stay in your house, he/she can only live with you for no more than 14 consecutive days. If they stay longer, and someone reports this, you voucher will be taken away.
How long does the application process take?
Typically, any type of subsidized housing is EXTREMELY popular and the wait can be very long. This is especially true in large cities across the US. In these areas, Section 8 wait time can be as long as 2-4 years. In less competitive areas you can expect to wait 6-12 months.
When you are on the wait list, it is important to check in once in 2-3 months to make sure that you are on the active list and that your place in line is moving.
If you live in an area where the wait time is very long, but you can move to a less competitive location, it may be a good idea to do so.
Applying in smaller towns may significantly reduce your wait time. Of course, this has to be balanced with your job and family obligations, and making a move may not always be an easy thing to do.
How does the choice housing voucher work?
Once you receive your voucher, you can start looking for a private apartment, where a landlord is participating is the Section 8 program.
It is important to realize that you will also need to go through the interview with the landlord before they will agree to sign the lease with you. All landlords conduct their own criminal background check and call references.
Be prepared that a landlord may turn you down because of your felony. When you interview with landlords, be honest about your past and discuss how you have changed. Be sure to have great references.
With the voucher, you will be paying 30% of your monthly gross income for rent. The rest is covered by the government and paid out directly to the landlord.
You will need to sign a 12 month lease with this landlord.
Once you leave a rental, you don’t loose your voucher, you will be able to use it again at your next place of residence.
Who can help with housing search and application?
If you feel that searching for an applying for Section 8 is too hard and confusing, there are a few places to seek help.
First, there are local Housing Search Agencies and Community Action Programs (CAPs), where workers will help you start the search for the right housing programs, and can assist with filling out the application.
You can also try a local Housing Consumer Education Center (HCEC), as they too provide search and application assistance.
Finally, if you have a family with children and are already homeless or at risk of becoming homeless, you should contact your local Department of Transitional Assistance office (DTA). They can help you search for housing and get priority status.

I’m a 55 yr old disabled Mom of a 15 yr old son and we’re homeless. I have been convicted of receiving stolen property, possession of controlled substance ( meth) and in 2000 I was convicted of manufacturing meth because of my husband having a lab in our garage that I honestly knew nothing about. Anyways I haven’t been in ANY KIND of trouble since 2000 and in 2005 I went through a 6 month in house drug treatment program and completed it. We’re homeless because I’m tired of being abused by my son’s father. If I can show proof of treatment oh and my only income is SSA/SS $678 a month. But with proff do you think I could possibly receive a section 8 voucher? Also being disabled and no longer able to work I don’t know what else to do because I have no family and I am worried I might have to go back to living with my son’s father and getting abused
Hate to say this but I think the Meth manufacturing conviction with exclude you from Section 8. You could try an appeal process and see but I am not hopeful…

I was an abusive marriage for 22 years and I turned to gambling which got me I trouble when I got home I went to gambling meetings. I’ve been cleaned from gambling for 9 years and divorce since would I qualify for section 8 on Long Island?
I believe if you’re honest about it and show remorse, but also show you’ve changed you should be ok. I’m guessing the gambling led you to commit grand theft? It wouldn’t hurt to ask friends, ppl in your program to provide you with character references. I think if you own it like you have, don’t make excuses for it and show you have changed it may go a long way! You have paid your dues. Best of luck. Gambling is probably the hardest addiction to overcome and you have been on the straight and narrow for 9 years. Way to go!

I could be wrong but I’m fairly certain that HUD’s rules are; no meth related felonies and no lifetime s*x offender registries, but good luck, I may be incorrect. Apply and see how it goes, although MANY places will deny you housing over a felony period, but especially a drug related one. My local housing authority states ON THEIR WEBSITE that it is HUD that doesn’t allow assistance to anyone with drug related felonies, which is NOT true. They DO allow assistance(except for meth I think), HOWEVER each individual housing manager has the right to deny you housing based on your charges. But it really makes me mad that my local housing authority says it’s HUD that won’t allow assistance to anyone with ANY drug related felonies and that’s just total BS!!
Sorry I got on a bit of a rant, but it just angers me that “most of the world” doesn’t think people can change and won’t give you a fair shot once you have that big bad felony.
People that get out of prison need to have some kind of support system waiting on the outside because once you get out it’s like “Oh you’re a felon that just recently got out of prison and you want to LIVE here?? Ohhh no, we can’t have that” and “Oh you’re a felon and you want to WORK here??? Ohhh no, we can’t have that!!”

It is really sad, and what gets me is what makes them think a felony of oh I don’t know say pound of weed qualifies you, however a manufacturing charge that is 10 years old (that is what I have) and even though I do not know how to manufacture meth, the person that was making it in my house was wearing a wire and basically dragged me under for being an addict. I had 5 years over my head in 2010 I took the plea because they said that if I do not plea down to 10 months and 5 yrs probation then I will have to do the whole 5 years. I had court appointed lawyer, and it was my first and only time I ever got into trouble. At that time I was 26 (with a broken heart) and 2 children that was staying at their dad’s when the incident happened. I done my 266 days, got out in 2011 and was living in a tent at a family member’s yard. Then I got a one-way ticket on a greyhound to Roanoke City, homeless shelter where I stayed on the streets for a few months and still couldn’t see my kids. They were with their father and my ex-best friend who he cheated on me with and threw me away like trash after being with him from ages 16-26 and he was 23 when I met him. Fastforward. I made my way up to christiansburg, to reunite with my father and got a job at Wendy’s, I was blessed to have a job for a few months until someone that knew about my past told on me and got me fired. I happened to befriend a guy who was willing to allow me to move in with him and his other room-mate and split bills. After a few weeks of staying with my new roommates, I discovered that one of my room-mates had feelings for me and so did I. We ended up getting together in the end of 2012. We moved out and into our own housing, he worked managing subway and I found a job for Arby’s. I got off probation in 3 years and paid off my fines. I was finally able to get my life back together and my older children with my ex began coming back into my life. In 2014 I gave birth to my third and his first baby girl and had emergency c-section from over working and caused placenta abruption. We both almost died, Anyways, she came out at 39 weeks weighing only 4 lbs but healthy. I went back to work in less than 4 weeks and paid my fines off in full with the next tax season. Almost a year and a half later I fell pregnant with baby number 4 a boy in 2016. I continued to have my other kids every other weekend and summers. I could not really work anymore cause of 2 small infants and my health was/ still is bad. We became homeless living in motel for a couple months right after our son was born, and then my child’s father (father) was involved in a wreck and discovered a tumor on brain had to be flown to uva for surgery. His father did not come home the same man, and basically his mother (him being the only son) asked us to move in with her to help her with his father with cancer who has refused treatments and is on hospice in 2016. Dec, 24 Christmas morning his father passed away. We are currently still here, as I have now had my civil rights restored, and am 10 credits away from graduating college with an Associates of Applied Science in Administrative Technology. I do not want to live with his mother forever but unfortunately because of covid, no assistance and still in school. I do not have a choice but to finish school. The thing is in the last 5 years the love of my life, father of my younger two children has not helped financially nor supported me with help. I get kids ready for school, dress them, cook, feed them, clean, deal with everyday escapades that a 6 and 4 year old brings. Also my oldest daughter came to live with me 2 years ago and is now almost 17 and she’s a whole new personality in itself. I manage to also stay up to date 4 college courses and he does whatever he wants; sleep in, eat, watch tablet, color etc. I am almost convinced he is a narcissist but def didn’t show his true color until after we have been together 5 years. I’m hoping to present myself and share my story with hud or section 8 and maybe they will reconsider because the Lord knows I have had so much hardship and not to mention a bad childhood. Also, the father of my two older kids has confessed that he made a mistake and wishes to be with me again, however I am not amused in the slightest and feel that he made his bed with my ex-best friend and he can stay in it. She turned out to be a nightmare for him, and basically ran all his kids out of house including our oldest daughter who resides with me. I plan to go to work with my new degree and hopefully have a decent home to call my own and be a single mom of 4 (two girls and two boys; ages 16, 13,6 and 4. btw my younger kids father or his mother does not treat my older kids right. and there is a lot of favoritism going on and it is sad and just toxic life to live like I have the last 5 years.
I’m currently on THDA waiting list and also Section 8 waiting list in Rutherford county. I’ve now been waiting on THDA waiting list since April 1, 2019 and Section 8 waiting list since June/July of 2019. I have a daughter that has Terminal Brain Cancer whom been diagnosed since September 15,2015 in which she receives disability. We recently lost our place in April 4, 2019 due to lost of income. For a short period of time we live with her sibling my oldest daughter which was not a good situation which lead for us having to sleep in out car from time to time. We are now staying in a motel that I have trouble paying for from week to week due to I have no income of my own only my daughter and because of the seriousness of her illness it would not be best fir her at a shelter environment. With that being said because of my me having no income of my on we face being on the streets/homeless from week to week. She does have a Social Worker thru her hospital where she currently goes for medical assistance so is there any grounds for us to receive emergency Section 8 seeing that we are already on the list? If so hiw do I go about getting help with that or who can I contact about oir matter? Any and all help is appreciated/welcoming!

I believe this disqualifies you for life but it could also depend on the state you live in.
I live in senior housing that is HUD. There is a neighbor who was CONVICTED of aggravated murder of his 2 year old stepson on Christmas eve about 50 years ago. This man is living amongst us his defense was he was mentally retarded (trust me he is not) and spent a short while in the mental hospital in the 70’s and now lives in our building. He is a bully and has threatened to kill a few residents and even held a knife to a man’s throat. The manager won’t do anything and when the police were called the manager gaslights the complaintants and makes them look foolish to the police. What can we do to get him out? He is a danger to all who live here.
Then this is a different scenario then the one with someone has changed their life and no longer a threat. I no this is a old post, so I hope the problem has been resolved. If not this is what I would do. Two approaches: 1) Start calling and filing complaints within the HUD branch, if the landlord still hasn’t solved the issue.
2) Same thing with police. Go to the officers Commanding Officer and keep going up the line.
Closed mouth doesn’t get feed so do this continual not just once. I would also try to catch something to record on my phone so you’ll have proof to them of the situation.

Well I was found guilty of felony 5 receiving stolen property in 2010 , I have 2 domestic violence threats from 07/08 (was arguing with a sibling who claimed I threatened bodily harm) but nothing major otherwise (few disorderly conducts and arguments with my siblings who I no longer associate with) , I live in ohio . I know I’m not eligible for his housing , am I eligible for any other housing programs ? In disabled and not permitted to work anymore, housing is too expensive to be able to rent a place on my own and I have been mostly homeless (2 years couch surfing) since 2013. Any links or phone numbers you can send me that could possibly help out with finding and paying for a place to live would be a blessing.
My brother is 62 and currently homeless. He has a manslaughter charge from 21-22 years ago. He spent 19 years in prison and was released March 2018. He’s on community watch (not parole). He was just released from the hospital after suffering a heatstroke. Any help is greatly appreciated. Can he qualify for section 8 or low income housing?

Wow. You don’t even know the circumstances that led to his conviction. Manslaughter could be an array of different scenarios.

I do not have a felony, but my boyfriend does. It’s only been 6 mo and he has only been out for 1 mo. I don’t know if we would qualify i don’t want to waste anyone’s time his felony charges are tampering with emergency call domestic and drug procession on church property. He has not been able to find a job yet and now we are on the streets with 2 very young kids. We want to keep our family together but it seems like its going to be impossible with his background
If I’m looking for housing with section 8 I’m afraid I want be excepted my actual date of my last charge was March 31, 1999 but I have only been home 7yrs I no Florida is very tough on ex felons but I will never go back no matter my situation I have prior drug offenses when I was young but spent my time changing have a excellent companion and family I strongly believe work history and showing you are productive member of society should gradually lift some if not all of the things that bar felons I truly feel for felons who come home with no family structure through death over the years is a sad way to treat the ones that have the passion and drive to be excepted again

You can apply for an emergency section 8, but to get on a list, you need to be “officially” in shelter. People at shelter would be able to give you info on how to apply and where to go next, in your city/state.
